Terms of Service
These Terms of Service (the “Terms”) set forth the conditions for using “Companion Journal” (the “Service”), provided by the operator of Companion Journal (the “Operator”, “we”, “us”, or “our”). Anyone who uses the Service (a “User”) is deemed to have agreed to these Terms.
Article 1 (Applicability)
These Terms apply to all relationships between the User and the Operator in connection with the use of the Service. The Operator may establish various rules, guidelines, and other provisions related to the Service in addition to these Terms (collectively, “Individual Provisions”). Regardless of their name, Individual Provisions form a part of these Terms.
Article 2 (Registration)
Registration is completed when an applicant who wishes to use the Service applies for registration in the manner prescribed by the Operator and the Operator approves such application. The Operator may refuse registration if it determines that the applicant falls under any of the following circumstances:
1. The applicant reported false information when applying for registration.
2. The application is made by a person who has violated these Terms in the past.
3. The Operator otherwise deems the registration inappropriate.
Article 3 (Account Management)
Users shall manage their account information for the Service appropriately at their own responsibility. Under no circumstances may Users transfer or lend their user ID or password to any third party. If a login is made using a combination of a user ID and password that matches the registered information, the Operator will deem such use to be by the User registered for that user ID.
Article 4 (Fees and Payment Methods)
Some features of the Service are paid. Users shall pay the fees separately determined and displayed by the Operator using the method specified by the Operator. Fees once paid will not be refunded except as required by applicable laws and regulations.
Article 5 (Prohibited Acts)
In using the Service, Users must not engage in any of the following acts:
・ Acts that violate laws or public order and morals
・ Acts related to criminal activities
・ Acts that may interfere with the operation of the Service
・ Acts of collecting or accumulating personal information, etc. regarding other users
・ Acts that infringe intellectual property rights, portrait rights, or privacy of the Operator, other users, or third parties
・ Other acts deemed inappropriate by the Operator
Article 6 (Suspension of the Service)
The Operator may suspend or interrupt all or part of the Service without prior notice to Users if any of the following applies:
1. When performing maintenance, inspection, or updates of computer systems related to the Service
2. When provision becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
3. When computers or communication lines, etc. are stopped due to an accident
4. When the Operator otherwise determines that it is difficult to provide the Service
Article 7 (Disclaimer)
The Operator makes no warranties, whether express or implied, that the Service is free from defects in fact or in law (including, but not limited to, safety, reliability, accuracy, completeness, and fitness for a particular purpose). The Operator shall not be liable for any damages incurred by Users arising from use of the Service, except in cases where the Operator has acted intentionally or with gross negligence.
Article 8 (Intellectual Property Rights)
All intellectual property rights relating to the Service belong to the Operator or legitimate third-party rights holders. Secondary use, reproduction, or diversion of text, images, programs, and other materials provided through the Service is not permitted.
Article 9 (Handling of Personal Information)
The Operator will appropriately handle personal information obtained through use of the Service in accordance with the Operator’s privacy policy. The Operator will not provide personal information to third parties without the User’s prior consent, except where required by laws and regulations.
Article 10 (Changes to the Terms)
The Operator may change these Terms without notice to Users if deemed necessary. Changes become effective at the time they are posted on the Operator’s website. If a User uses the Service after the changes, the User is deemed to have agreed to the amended Terms.
Article 11 (Notices or Communications)
Notices or communications between Users and the Operator shall be made by the method prescribed by the Operator. Unless the User has submitted a change notification in the separately prescribed manner, the Operator will deem the currently registered contact information to be valid.
Article 12 (Governing Law and Jurisdiction)
These Terms shall be governed by the laws of Japan. Any dispute arising out of or in connection with the Service shall be subject to the exclusive jurisdiction in the first instance of the Tokyo District Court or the Tokyo Summary Court.
